<p>Bank of Nova Scotia — aka ScotiaBank — filed the complaint with World Intellectual Property Organization (WIPO) to get the domain name from Working Word Co-operative, which publishes Word Magazine.Hongkong net center</p>
<p>Working Word told WIPO that it acquired the domain name in 1997 with the approval of the group that owned the trademark at the time. Due to financial problems with the festival, ownership of the Caribana mark has changed several times.Hongkong net center</p>

<p>The WIPO panel <a href="http://www.udrpsearch.com/wipo/D2010-0167">found</a> in favor of Working Word, deciding that it registered the domain name in good faith in 1997 with the approval of the event’s organizers. <p>This case brings up an interesting point. I see trademark licenses handled in different ways when it comes to UDRP cases. Often times a panel will find that the owner of the mark, not a limited licensee, should bring the case. Here, if ScotiaBank had won the case, what would happen when it was no longer title sponsor of the event?Hongkong net center</p>

<p>When I first started buying domain names in around 2003, I didn’t understand the legalities of registering domain names that contained trademarks. In fact, I registered a few domain names that were infringing on the marks of other companies. After getting a cease and desist letter from one company and giving the registration fee domain name to them, I decided I didn’t want to take a chance with this type of name.</p>
<p>In going through my portfolio to try and sell some names to end users, I realized that I have a few names that aren’t as generic as I once thought.</p>
<p>I own a number of city-keyword domain names, and I started looking through them to sell a few to end user buyers. I own quite a few cityMortgage.com and cityMortgages.com domain names. One is a city in Texas with somewhere around 100,000 people, and I am sure many of the city’s homeowners have mortgages, and there are a number of companies offering mortgages in this city.hongkong net center</p>
<p>In doing some research, I found that there is a bank in Maryland that uses the Texas city name + Bank (I don’t want to draw attention to the name I own, so I am leaving the bank name out). Without getting into legalities since I am not a legal expert, it would probably be okay to sell this City Mortgages.com name to a mortgage company in Texas, but if I pitched it to the Bank in Maryland, they could very well claim trademark infringement. I suppose they could do that anyway, but having an email from me offering to sell the name would make their case stronger.net-center.org</p>
<p>Point of this post is that when you do reach out to end users to sell generic domain names, you need to be sure that the domain name is actually generic. I almost sent this bank an email assuming they were located in the city rather than using the name as their trademark, and had I not seen the Maryland area code on the site, I probably would have sent it.net-center.org</p>
<p>There are many generic terms that are used by companies to form distinctive trademarks, and there is a whole lot of gray area, so use caution.</p>

			<content:encoded><![CDATA[<p>The latest SmartCompany Dun &amp; Bradstreet Industry Growth List for the telecommunications sector reveals an industry in flux.</p>
<p>Telcos both large and small are benefiting from the transformation of internet access from a luxury purchase into a commodity. The increased adoption rate of new technology such as wireless connections are also driving growth, along with increased demand for mobile data plans as internet-enabled smartphones flood the market.(hongkong net center)</p>
<p>But competition in the sector remains fierce and margins tight. The telecommunications industry is set for a period of massive consolidation in order to sustain its growth.(hongkong net center)</p>
<p>The total revenue of the top 50 companies came to $39 billion for the 2008-09 year, representing a solid increase from the $33 billion recorded during 2007-08. Average revenue was $781 million, with average growth of 78%.</p>
<p>But while telcos are benefiting from new services and technology, growth has levelled off and this has resulted in a massive wave of consolidation. With smaller companies unable to grow by themselves, larger businesses are looking to acquire smaller services-based telcos which bring large customer databases and specialised skills.</p>
<p>Perhaps the biggest consolidation effort over the past year has been Vodafone and Hutchison&#8217;s merger, creating the new VHA entity. But most of the acquisitions have been in the SME space, for example, with TPG purchasing Pipe Networks and Vocus being bought out by a private equity firm within the last few months.</p>
<p>M2 Telecommunications Group, a telco which offers services to SME customers, has been one of the largest acquirers in the industry since the financial crisis began. Last year it finalised two massive purchases of People Telecom and Commander Communications, adding over $200 million in revenue, while recently it acquired certain assets of Clever Communications.</p>
<p>Managing director Vaughan Bowen says the company is growing organically and is keen to keep focusing on its core customers, but says consolidation will be the order of the industry for the short-term.</p>
<p>&#8220;There is certainly a lot of consolidation going on,&#8221; Bowen says. &#8220;We are obviously a statistic in that and have been active in that space over the past three years. But I think 18 months ago when the industry got a shock it made vendors&#8217; expectations a little more adjusted, and now discussions are being made on more realistic financial levels.&#8221;</p>
<p>M2 is seventh on the industry growth list, with 2009 revenue of $202 million, from $109 million during 2008. It recorded a solid growth rate of 85%, due in no small part to the acquisitions from the previous 18 months. But Bowen says organic growth is a core part of the company&#8217;s strategy.</p>
<p>&#8220;There are a lot of participants in the industry which are acquiring other businesses, but we are not just an acquirer. We are growing organically, we still have ambitions for growing organically and we are very much focused on that as well.&#8221;</p>
<p>&#8220;We are also not at all interested in the acquiring of businesses which aren&#8217;t operating in the SME market. We&#8217;re not trying to be all things to all people, because the possible mistake you can make there is when you expand beyond your level of awareness. We&#8217;re not participating in markets outside our core presence.&#8221;</p>
<p>But while consolidation is certainly occurring, some say the trend isn&#8217;t really consequential. Ovum research director David Kennedy says that while IT companies are acquiring to grow in a tough environment, many of them are too small to matter and larger mergers rarely occur.</p>
<p>&#8220;There are only about a dozen telecommunications companies that count in the Australia market, the rest are small ISPs. There does seem to be a process of consolidation going on, mainly second tier players like iiNet acquiring small regionally-based ISPs in order to grow scale, or TPG acquiring Soul and Pipe to grow scale and get control of their transit costs.&#8221;</p>
<p>&#8220;There have been many predictions of ISP consolidation over the years, but they often haven&#8217;t come true. But if the NBN gets up, this might accelerate consolidation since it&#8217;s a resale model where scale is more important.&#8221;</p>
<p>Perth-based ISP iiNet, currently the country&#8217;s third largest telco, has been keen to acquire smaller companies in an attempt to challenge the industry leaders, Optus and Telstra.</p>
<p>It most recently bought Melbourne-based ISP Netspace for $40 million, giving it a significant base on the east coast from which to enter Tasmania. Prior to that, the company bought Westnet in 2008 for $81 million, boosting its subscriber base by thousands and providing it with a significant increase in revenue and profit.</p>
<p>Managing director Michael Malone says the company has been able to challenge market leaders and grow its market share to 12.4%, closer to its 15% target, through marketing new services such as Naked DSL to financially-conscious customers.</p>
<p>Additionally, he says while the past year has been a hectic one for the business, he feels the next 12 months could be even bigger and is open to the possibility of further acquisitions.</p>
<p>&#8220;Buying an ISP is easy if you&#8217;ve got the money, it&#8217;s just a matter of negotiation. We don&#8217;t expect that purchase to be the only one in the next one or two years. We&#8217;ve already seen VHA and Hutchison and a few others. Three of the top 10 have either sold or are in play, and I think that&#8217;s a significant factor.&#8221;</p>
<p>The past year has been a massive one for the company. Not only has it undertaken a push onto the east coast with a comprehensive marketing campaign, it also successfully dealt with a legal challenge from some of Hollywood&#8217;s largest entertainment companies.</p>
<p>The group, represented by the Australian Federation Against Copyright Theft, accused iiNet of authorising illegal downloads made on its networks. However, the Federal Court ruled that just because iiNet provided internet access to copyright offenders did not make the company itself liable for those infringements.</p>
<p>&#8220;Every conversation would be about it, even with friends down at the pub. But I didn&#8217;t want staff talking about litigation, I would want people talking about what we can offer our customers and what new experiences we could offer.&#8221;</p>
<p>The company has recorded revenue of $418 million for the 2008-09 year, up from the $251 million recorded during the previous year. Its most recent half-yearly results show revenue increased by 11% to $228.1 million, up from $205 million during the previous corresponding period.</p>
<p>Some of that revenue has been from expanding into new areas, such as consumer electronics. Malone says developing the BoB phone and router combination was new territory for the company, and something they will explore further with the launch of IPTV.</p>
<p>But Malone says the industry is at a point where growth is hard to come by, and acquisitions will become more common as firms struggle to gain market share.</p>
<p>&#8220;The market is saturated. For the last few years, as long as you&#8217;ve been able to do a fairly good job, you&#8217;ve gotten your fair share of market growth. But now we are growing slowly, and now companies are really fighting for market share.&#8221;</p>
<p>Malone points out that as broadband products become more complicated, users want more service – not less. This is why he says broadband is not a commodity just yet, and customer service is more important than ever.</p>
<p>&#8220;In the home, it used to be just one computer connected to the phone socket. It isn&#8217;t like that anymore. Now you have a bunch of devices all interconnected. I don&#8217;t think it&#8217;s a commodity yet, because if a product is generic you really don&#8217;t need help using it. I think broadband is going the opposite way.&#8221;</p>
<p>&#8220;But I think that&#8217;s a positive thing because we&#8217;re differentiated as a service-based company. People want a trustworthy brand, loyalty, and I think we&#8217;ve held up well in that regard. Several years ago we saw males making the decision for the household, but now 70% of internet-related decisions are made by females. They want a brand position, service offerings and so forth. It&#8217;s a big market shift.&#8221;</p>
<p>As iiNet grows, it is increasingly being compared to the nation&#8217;s biggest telcos – Telstra and Optus. But Malone says competing with Telstra is harder than it looks, and that its position as the safe and default option for telco services makes it more difficult for the company to operate.</p>
<p>&#8220;I don&#8217;t think Telstra is doing a bad job, I think they&#8217;re doing a good job and it&#8217;s something I worry about constantly. When people move houses, there is a perception that to connect your phone you need to call Telstra. It&#8217;s a perception issue, and that&#8217;s where we lose customers to Telstra.&#8221;</p>
<p>&#8220;On the other hand, we have people moving away from Telstra, saying they want better value and service. It&#8217;s a customer relationship issue. Telstra has the highest margin in the industry, and people go there because of safety – if they invest that in outstanding service, they will dominate that factor as well.&#8221;(hongkong net center)</p>
<p>But Malone isn&#8217;t afraid of the two biggest telcos taking more ground. He says iiNet is growing organically, and he&#8217;s constantly searching for ways to increase revenue.(hongkong net center)</p>
<p>&#8220;We are still growing organically. I could probably go and play golf for a year and the business will be fine. But I want to know where we&#8217;re going to get our growth for the next three years. What customers do we need, and what products? That&#8217;s what I&#8217;m worrying about &#8211; not tomorrow, but three or four years from now.&#8221;</p>
<p>Sydney-based My Net Fone has been one of the smaller telcos in the country over the past few years. The company reached 13th on the list, recording $6.8 million in revenue during 2007-08 and a further $9.7 million during 2008-09, representing growth of 43% over the previous three financial years.(hongkong net center)</p>
<p>The company focuses on VoIP services, and recently introduced Naked DSL to broaden its customer base. But it recognises its reach is small, and is open to the idea of being bought out – or buying out another firm – to increase its scope.(hongkong net center)</p>
<p>&#8220;Consolidation isn&#8217;t anything new. The telecommunications industry is another industry whereby you have constant changes, and that is for all sorts of reasons. New business models, different technologies and customer preferences all change, especially with new additions of social media like Facebook and Twitter.&#8221;(hongkong net center)</p>
<p>&#8220;You basically have to keep changing with the trends of the customers, and obviously consolidation occurs apart of that. We would consider an acquisition, sure, because we are here to serve our shareholders. Whatever is best for the shareholders is best for the company, that could possibly include an acquisition.&#8221;(hongkong net center)</p>
<p>Fung says this offer was extremely attractive during the downturn, as customers were looking to retain their internet connection but save money at the same time. But Fung says the company has also adopted many of its products to businesses. Its Virtual PBX product allows SME customers to set up an internal network without the need for purchasing upfront physical cable equipment.(hongkong net center)</p>
<p>Doing away with traditional telephone rental lines frees up some spare cash, and MyNetFone attempts to keep subscription prices as low as possible to draw customers in from its larger competitors.</p>
<p>&#8220;Obviously with our call rates, and the savings in capital costs, we&#8217;ve gained a lot of popularity. VoIP and Naked DSL really allows customers to make a lot of savings, up to 60% in some cases, and the second factor is that VoIP offers a practical advantage in terms of flexibility.&#8221;(hongkong net center)</p>
<p>&#8220;It&#8217;s giving the extra value and convenience of a flexible phone and internet system. Changes happen in organisations, people move offices, new staff come in, and with traditional systems it&#8217;s confusing setting someone up. These systems are more flexible and you don&#8217;t need any more administrators spending their time with confusing systems.&#8221;</p>
<p>The company&#8217;s success is slightly surprising, given that it shuns traditional advertising for the most part. Instead, it focuses on word-of-mouth and wants to draw up a solid customer base before it embarks on advertising through traditional media.</p>
<p>&#8220;We don&#8217;t actually advertise all that much. The word-of-mouth marketing is actually very important because we don&#8217;t really heavily advertise in the public endeavour. People use the service, find they are happy with it, and then go and introduce it to their friends and colleagues.&#8221;</p>
<p>&#8220;I should clarify that we do advertise, but we also do it very specifically and make targeted efforts in promotions. We&#8217;re not doing that, at least not yet anyway, while we build up the company&#8217;s strength in other areas.&#8221;</p>
<p>Even with advertising, MyNetFone faces some tough competition. Larger competitors such as iiNet, Telstra and Optus all offer Naked DSL, and have a larger customer reach. How does Fung keep MyNetFone&#8217;s popularity high despite the larger players in the market?</p>

<p>This listing has been ranking for my company&#8217;s name ever since this blogger put it up.</p>
<p>He writes, &#8220;Ohh I see&#8230;Sage Lewis is one of these dirtbag SEO&#8217;s who has never achieved anything&#8230;Even his company site despite using this amazing technique is not even listed in the top 100 for any of these spammy keywords.&#8221;</p>
<p>This was a really surreal experience for me when it happened. The blogger in question appears to look down on the SEO (<a href="http://searchenginewatch.com/define#seo" target="_new">define</a>) industry, all the while intentionally using standard SEO techniques to rank on very specific phrases to attack me.</p>
<p>&#8220;What do you do about these kinds of things, Sage?&#8221;hongkong net center)</p>
<p>I&#8217;ve recently been asked this more and more as we increasingly see user-generated comments get injected into the search results.</p>
<p>I&#8217;ve seen companies take many different actions:</p>

<li>Inject fake comments into the discussion, pretending to be disinterested third parties.</li>
<li>Try to scoop up the domain if the angry person lets it expire.</li>

<p>My experience has been that if you fight fire with fire you just get more fire.</p>
<p>Most bloggers are confident in their position online. Every lawsuit I&#8217;ve ever seen threatened on a blogger typically just makes them dig in more. Then, if you are a large company, you often just come off as a big meanie trying to push around the little guy.hongkong net center)</p>
<p>Pretending to be a happy customer or making up user-generated content runs the risk of exposing you as a charlatan. You might end up looking worse than when you started.hongkong net center)</p>
<p>Fabricating anything runs the risk of just more fuel for the angry person to use against you, if you get found out.</p>
<p>In my experience, you have two ways to go.hongkong net center)</p>
<p>First, if the person who is attacking you is causing you significant brand damage, and you want to get it corrected, <em>love is the only way to go</em>. It may not work, but it&#8217;s your only hope of getting them to change their mind.</p>
<p>I don&#8217;t recommend bribing them. But I do recommend giving them as much attention as you possibly can.</p>

<li>Give them free products.</li>
<li>Have your CEO contact them.</li>
<li>Fly them into your organization as a VIP.</li>
<li>Offer them the ability to do an interview with a high level executive in your organization.</li>

<p>If Fox Business or CNBC went after your company in a negative way, you would be all over it. It would be priority number one for PR, brand, and marketing to deal with that head on. Your CEO would be on that station immediately. Bloggers, often because of Google&#8217;s ordaining, are now just as important&#8230;if not more so.hongkong net center)</p>
<p>&#8220;<a href="http://www.youtube.com/watch?v=5YGc4zOqozo" target="_blank">United Breaks Guitars</a>,&#8221; with 8.3 million views on YouTube, continually dominates the top search listings in Google for the phrase &#8220;United Airlines.&#8221; I would give that guy the world for him to either take that video down or do another one that recaps his &#8220;amazing experience&#8221; with the customer service American Airlines wants to be known for.hongkong net center)</p>
<p>Bloggers want respect. They want to be treated the way other media channels are treated. I believe that&#8217;s the way it should be.</p>

<p>There’s little better than owning a nice, short domain name for your company. It’s part of the reason I sprung for DNW.com.</p>
<p>Within the past couple weeks two different end users have purchased three letter domains of their own.hongkong net center</p>
<p>First is Mack Energy Corp, which paid a hefty $99,000 for <strong>MEC.com</strong>. Mack Energy Corp. is an oil exploration company.hongkong net center</p>
<p>Second is First Fidelity Bank, which has been using the sub-prime domain name First-Fidelity.com. The bank paid $18,000 to get the domain name <strong>FFB.com</strong>.hongkong net center</p>
<p>Each week, hundreds of end users buy domain names on the aftermarket for their business. Here are some other recent end user purchases:</p>
<p>PremierAdvantage.com – The Venetian in Las Vegas paid $4,500<del datetime="2010-04-14T19:50:32+00:00">0</del>. Perhaps it will be for a rewards program?hongkong net center</p>
<p>HealthInvestment.com – HIF Corporation, which operates as “Health Investment &amp; Finance”, picked up this improved domain name. So far it has yet to forward it to HIFCorporation.com.</p>

<p>Don’t worry… despite the title of this post, I am not going to try and sell you some magical e-book on how you can make $50,000 a year in extra income. I am going to tell you about something I am trying on my own, and I will update the post in a few weeks to let you know how it is going.</p>
<p>I blogged about <a href="http://www.elliotsblog.com/successful-end-user-sale-from-start-to-finish-2981">an end user sale</a> that I made a couple of weeks ago. The domain name wasn’t newly registered, but I did pick it up on the drop for a few hundred dollars and sold it for much more. In the comment section, I also wrote about another end user sale that I made last week with a newly registered domain name following the same strategy as the sale outlined in the post.(hongkong net center)</p>
<p>On Friday April 2, I hand registered ExecutiveHeadshots.com, and on the following Monday, I sent off about 20+/- emails to companies listed in Google for that keyword. I received 4 replies with interest seeking the pricing, and I came to a sales agreement with a buyer after negotiating for a couple of days.(hongkong net center)</p>
<p>The name is currently in escrow with <a href="http://www.escrow.com/" target="_blank">Escrow.com</a>, and unfortunately the buyer chose to mail a check to Escrow.com rather than pay via Paypal, so the sale won’t close for a week or two while the check clears. However, I turned an $8.00 registration into a very strong sale (although I won’t reveal the price as mentioned before).(hongkong net center)</p>
<p>With two successful end user sales in a month, I started thinking about ways to blow this out and make some real money. If I am able to register one GOOD domain name that a company would want either to re-brand or to help with SEO each week for a year, and I sold it within a week for $1,000 +/-, I could make $50,000 in extra income a year.(hongkong net center)</p>
<p>It’s probably not going to be as easy as it sounds, but I am going to give it a try. I registered a domain name on Friday and started pitching it to end users today, with one reply already. Once I have some results, I will post them, but I wanted to let you know what I plan to do ahead of time.</p>
<p>One piece of advice I can offer now is that actual product (not brands) or service domain names will be much better than descriptive domain names in most cases. For example, AwesomeHeadshots.com would not be a good alternative to ExecutiveHeadshots.com, as many photographers use “Executive Headshots” in their meta description and page titles since they cater to people looking for executive headshots, despite the fact that they may want awesome headshots(hongkong net center)</p>

			<content:encoded><![CDATA[<p>Businesses worried about cyber attacks like the one that hit Optus earlier this week should ensure they are properly backing up their data, but experts says there is little SMEs can do to prepare for such attacks and protect themselves. (hongkong net center)</p>
<p>Optus, the nation&#8217;s second largest telecommunications company, has confirmed that one of its major customers was hit by a denial of service attack originating in China. A spokesperson said in a statement that the strike was a denial-of-service attack, designed to flood a website with massive amounts of traffic in order to overload its servers and bring it down.</p>
<p>&#8220;At approximately 1.10pm yesterday one of Optus&#8217; customers experienced a denial of service attack. The attack originated in China,&#8221; the spokesperson said.(hongkong net center)</p>
<p>&#8220;The attack caused congestion on one of Optus&#8217; international links leading to slow internet and delayed email for some Optus corporate customers. At 3.25pm Optus resolved the issue by blocking the source of the attack.&#8221;</p>
<p>It is understood that the Australian Associated Press was taken down, however, it is unclear whether AAP itself was targeted or whether Optus itself was the sole focus of the attack. News Limited has also claimed to be impacted by Chinese-based attacks.(hongkong net center)</p>
<p>But Jim Stewart, chief executive of SEO firm Stewart Media, says if a hosting provider is hit by such an attack which filters to its clients, there isn&#8217;t much businesses can do to get their site back online.(hongkong net center)</p>

<p>But Stewart warns that if a business has its domain name and hosting services handled by the one company, and that company suddenly suffers a shortage or attack, there is nothing much that business can do – and it&#8217;s an underestimated problem.(hongkong net center)</p>
<p>&#8220;Hosting is more important than ever these days and not enough people realise it. It&#8217;s so important, and what companies don&#8217;t realise is that they get what they pay for&#8230; if you pay cheaply you can end up on an IP address with several other entities and that results in an underpowered server.&#8221;</p>

<p>Anthony Edwards, technical support manager at TrendMicro Australia, says businesses don&#8217;t have much recourse to prepare for a denial of service attack and are at the mercy of their hosting provider.</p>
<p>&#8220;Denial of service attacks are pretty tough to protect against. There are some contingency plans users can put in place, such as perhaps organising a second connection they can switch over to. Optus tried to do something like that, really it just has to be stopped at a higher level and there isn&#8217;t much businesses can do expect tough it out.&#8221;(hongkong net center)</p>
<p>&#8220;For the type of attack that constitutes a denial-of-service attack, it&#8217;s focused on bandwidth, and therefore extremely tough to protect or even prepare against.&#8221;</p>
